Our client, a 24-year-old waste management worker, was on the job in the parking lot of a pier on the San Francisco Bay when he was hit by a motor vehicle operated by the defendant, a security guard working for a private security company contracted to provide security for the site. At the time of the incident, the defendant was investigating suspicious activity in complete darkness after one of the parking lot generator lights shut off.
Our client suffered severe personal injuries that required multiple surgeries, including a fractured skull, a fractured hand, and a traumatic brain injury. He was left with a permanent hand deformity despite undergoing pinning surgery. An MRI revealed that his brain injury was especially severe.
Before trial, the defendant served an offer of $635,000 and later offered $1,000,000 at a mandatory settlement conference just before trial. Both offers were rejected, and after a 15-day trial, the jury returned a verdict in favor of our client, apportioning 100% of the fault for the accident to the defendant and his employers. Our client was awarded significant damages to cover his medical expenses, lost wages, and pain and suffering.
